Comments: the participant must have full civil capacity for the conclusion and execution of the contract.
The participants of the purchase must comply with the requirements of the legislation of the Russian Federation to the persons carrying out the works, which are the subject of purchase, including the requirements set forth in the tender documentation on Open one-stage competition № 907251.
In accordance with 1 and 2 of art. 2 of the Federal law of the Russian Federation from 18.07.2011 № 223-FZ "on procurement of goods, works, services by separate types of legal entities", this request of prices is carried out according to the unified standard of procurement of PJSC "Rosnets", in accordance with article 4 of art. 447 of the Civil Code of the Russian Federation the request for prices is not a bargaining and is not regulated by art. 447-449 of the Russian Civil Code. This procedure is also not a public competition and is not regulated by articles 1057-1061 of the second Civil Code of the Russian Federation. The purchase organizer has the right to refuse all received applications for any reason or to terminate the request procedure. Thus, this RFP procedure does not impose the corresponding amount of civil and legal obligations on the Customer.
The purchase is carried out in electronic form (the application of the participant is provided only electronically through the functional of the ETP. The participant's application on paper is not provided)
The customer has the right to refuse to request prices at any stage prior to the signing of the protocol at the choice of the winner, without incurring any liability to the participants of the price request or third parties to whom such action may bring losses.
The terms of the contract concluded according to the purchase results are specified in Appendix № 2 to the procurement documentation "draft contract".
The contract between the customer and the winner shall be no earlier than ten days and not later than twenty days from the date of placement in the Unified Information System (www.zakupki.gov.ru) of the final Protocol, drawn up on the results of the competitive Purchase. In case of necessity of approval by the management body of the customer in accordance with the legislation of the Russian Federation the conclusion of the contract or in case of appeal to the antimonopoly body of actions (inaction) of the customer, the Competition Commission, the operator Electronic platform The contract shall be concluded no later than five days from the date of the said approval or from the date of the decision of the antimonopoly body on the results of appeal of actions (inaction) of the customer, the Competition Commission, the operator Electronic platform.
