Comments:
1.This competitive procedure for the preliminary selection of a Supplier is directed in accordance with the Tender Regulations of the Organizer as part of the procedure for requesting commercial proposals, which (like the ongoing procedure for the preliminary selection of a Supplier) is not an offer, auction or tender and its conduct is not regulated by Articles 447-449 Part 1 and 1057-1061 Part 2 of the Civil Code of the Russian Federation. Thus, this procedure does not impose an appropriate amount of civil obligations on the Organizer and reserves the right to refuse all received Offers for any reason or to terminate the selection procedure at any time without explanation, without incurring any liability to the Bidders.
2. The tender organizer reserves the right to select several winners by dividing the delivery of the specified quantity of goods at its discretion and without explanation among several potential suppliers-Bidders of the competitive procedure.
3. Applicants must, without fail:

4. After the competitive bidding process, the Bidder's offer price becomes fixed and cannot be increased.

An organization/documentation that does not comply with the requirements and forms specified in the Bid Notice may be rejected by the Organizer without explanation and recognized as this documentation, and, accordingly, the Applicant, does not comply with the requirements of this competitive procedure.
6. The winner(s) of the competitive bidding process is approved by the chairman of the tender committee, based on the results of all cumulative factors (price, deferred payment, availability/absence of advance payment, guarantee, standard conditions of Rusagro) |
